Terms of Use

KasiConnect Hub is an online marketplace and community directory. It lets people in South Africa list items for sale, promote businesses and services, and contact one another (the "Platform"). The Platform is operated by Fhulufhelo Nekabambe, of 29 Tshabuse Street, Masia Tshiphuseni.

In these terms "we", "us" and "our" mean the operator, and "you" means anyone who visits or uses the Platform.

• By visiting, registering for or using KasiConnect Hub, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Platform.
• If you register a business, you confirm that you are authorised to bind that business to these terms.
• We may update these terms from time to time. Continued use after an update means you accept the updated terms. For material changes we will tell members through the Platform or by email.

• You must be at least 18 years old, or use the Platform under the supervision of a parent or legal guardian.
• You must give accurate and complete information when you register, including your first name, surname, email address and WhatsApp number. Seller accounts must also give an accurate address.
• You must verify your email address before you can post listings, send enquiries or join community discussions.
• You are responsible for keeping your login details safe and for activity under your account. Tell us straight away if you suspect unauthorised use.
• Each person may hold one personal account. Do not create accounts to impersonate another person or business.

• Every account is either a buyer account or a seller account. A seller account is needed to post listings. Buyers can send enquiries and report listings, businesses or users.
• A sale or service is agreed directly between a buyer and a seller. KasiConnect Hub is not a party to that agreement, does not take payment for goods or services, and does not guarantee the quality, safety, legality or delivery of any item or service.
• Sellers must describe items and services honestly, state a fair price in South African rand, and deliver what they advertise.
• Buyers should inspect items, confirm details and agree on payment and delivery before paying. Be careful of requests for payment in advance from people you do not know.

• Businesses are registered through the Platform and are reviewed before they appear publicly. We may approve, reject, suspend or remove any business at our discretion.
• A business must be a real and lawful business run by the person who registered it. Its name, category, address and contact numbers must be accurate and kept up to date.
• Businesses must comply with the laws that apply to their products and services, including tax, licensing, consumer protection and advertising rules.

• Listings must be accurate, lawful and clearly described. Each listing needs a title, a description of at least ten characters, a price in South African rand, a category and a location.
• You may upload up to five photos per listing. Each photo must be a JPG, PNG or WebP image no larger than 5 MB, and must show the item being sold.
• Do not upload photos showing people who have not agreed to appear, personal documents, or other people's private information.
• We may resize, compress or remove images, and may hide or delete any listing that breaks these terms or the law. Listings may be checked before they go live.

• Post fake, misleading or duplicate listings, or list items you do not have the right to sell.
• Offer goods or services that are illegal, stolen, counterfeit, unsafe or restricted, including weapons, drugs and stolen property.
• Scam, defraud or deceive anyone, including through fake payment requests, fake delivery offers or impersonation.
• Harass, threaten or discriminate against other users, including on the basis of race, gender, religion, language, disability or sexual orientation.
• Send spam, unsolicited marketing or chain messages through the Platform, or to members you met on it.
• Use bots or scrapers, or try to access accounts, systems or data that are not yours.
• Attempt to hack, disrupt, overload or reverse engineer the Platform, or bypass any security or rate limit.
• Submit false reports or misuse the reporting tools.

• Any member may report a listing, business, community post or user. Reports should be honest and include evidence where possible.
• We review reports and may act at our discretion, including removing content, hiding listings, suspending accounts, or permanently deleting accounts and businesses. We will try to act within a reasonable time.
• We may suspend an account straight away where needed to protect members, investigate a complaint or comply with the law.
• Where we remove content or an account, we will try to tell you why, unless the law or someone's safety requires otherwise.
• Deleting an account removes your profile, businesses, listings, photos and community posts. Records we must keep by law may be retained as described in the Privacy Policy.

Our rights. KasiConnect Hub, including its name, logo, colours, page designs, text, graphics, software, code and databases (together, the "Platform Content"), belongs to the operator or its licensors. It is protected by the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993 and international treaties South Africa has joined.

Your content. You keep the copyright in the listings, descriptions, photos, business names, logos, profile information and community posts you submit (together, "Your Content").

Licence you give us. By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, display and distribute Your Content on and through the Platform, and to promote the Platform, including in search results and on our social media. The licence lets our service providers, such as hosting and image providers, process Your Content on our behalf. It lasts while Your Content is on the Platform, and for the short period needed to remove it from backups and caches afterwards.

Your warranty. You confirm that you own Your Content or have every right needed to give this licence, and that Your Content does not infringe anyone else's copyright, trade mark, privacy or other rights.

Limited use. We give you a personal, non-exclusive, non-transferable and revocable right to view and use the Platform for its intended purpose. You may share individual listing and business links with others. You may not copy, sell, modify, mirror or create derivative works of the Platform Content without our written permission.

Brand use. Do not use the KasiConnect Hub name or logo in a way that suggests we endorse you or your business. Do not register domain names, social media handles or trade marks that are confusingly similar to ours.

No scraping or AI training. Do not use automated means to copy, scrape, index or extract content or data from the Platform. Do not use the Platform Content or other members' content to train, test or improve any artificial intelligence or machine-learning model without our written permission.

Third-party material. Open-source software used in the Platform remains subject to its own licence. Third-party names, trade marks and logos shown on the Platform belong to their owners and are used only to identify the goods or services concerned.

Copyright and trade mark complaints. Send a written notice to fnekabambe@gmail.com with: your full name and contact details; a description of the work or mark you say is infringed; the web address (URL) where the material appears; a statement that you believe in good faith the use is not authorised by you, the owner or the law; a statement that the information in your notice is accurate and that you are authorised to act for the owner; and your signature, which may be electronic.

What we do. On receiving a valid notice we may remove or disable access to the material and will tell the member who posted it. Members who repeatedly infringe the rights of others may have their accounts suspended or permanently closed.

Counter-notice. A member whose content was removed may send a counter-notice to the same address explaining why they believe the removal was a mistake. If the complaint is not pursued further, we may restore the content.

Feedback. If you send us ideas or suggestions about the Platform, we may use them without any obligation to you.

• Nothing in these terms removes or limits any right you have under the Consumer Protection Act 68 of 2008, or any other law that cannot lawfully be excluded.
• Sellers who supply goods or services are responsible for meeting the obligations that apply to them under the Consumer Protection Act, including quality, safety and accurate information.
• If an item does not match its description, contact the seller first, then use our reporting tools. You can also contact the National Consumer Commission.

• KasiConnect Hub does not currently process payments between buyers and sellers. Payment, delivery and refund arrangements are agreed between the parties outside the Platform.
• If we introduce paid features or payment processing, we will publish the price and terms in advance and give you the chance to accept or decline them.
• Enquiries sent through the Platform are for communication. Moving the conversation to WhatsApp or another channel is your choice.

• The Platform is provided "as is" and "as available". To the fullest extent the law allows, we do not promise that the Platform will be uninterrupted or error-free, or that listings, businesses and user content are accurate, complete or reliable.
• We provide a platform that connects members. We do not control what sellers list, what buyers do with information they find, or how any deal turns out, and we are not responsible for losses arising from deals between members.
• To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data arising from your use of the Platform.
• Nothing in these terms excludes liability that cannot lawfully be excluded, or any right you have under the Consumer Protection Act.

• The Platform links to third-party services such as WhatsApp, Google sign-in, maps, social media and business websites. We do not control them and are not responsible for them. Their own terms and privacy policies apply.
• If you sign in with Google, Google shares with us only the profile details you allow it to share.

• You may stop using the Platform at any time and ask us to delete your account by emailing fnekabambe@gmail.com.
• We may suspend or end your account if you break these terms, if the law requires it, or if continuing would harm members or the Platform.
• We may change, suspend or discontinue any part of the Platform. Where a change materially affects your account, we will try to give you reasonable notice.

• These terms are governed by the laws of the Republic of South Africa.
• If a dispute arises, please contact us first at fnekabambe@gmail.com so that we can try to resolve it informally within 30 days.
• If it is not resolved, it may be taken to a South African court with jurisdiction. Nothing stops you from approaching the National Consumer Commission, a consumer tribunal, the Information Regulator or any other body with authority over the matter.
